Alimony in New York
There are two types of alimony in New York: temporary and permanent. Temporary or interim alimony is provided to a spouse during a divorce. This alimony is set using a statutory formula that looks and compares each party’s income. Adjustments can be made to this amount if there are special circumstances.
With permanent alimony, a judge has greater discretion and will award alimony based on a number of factors. This includes the length of the marriage, each spouse’s earning capacity, the age and health of each spouse and other factors.
